Workers’ Compensation in Florida is politically influenced. The legislature establishes and changes the rules, forms, procedures, regulations and cost. The head of the Department of Financial Services is an elected official. Consequently, much of the impetus behind the constant upheaval comes from lobbyists and special interest organizations.

There is no price competition between insurers as the State sets the rate per $100 of payroll. Numerous other factors which include medical and legal costs have made Florida unprofitable for many insurance companies. Low rates, unprofitable operations by insurance companies and Legislative decisions either have driven many of the standard market carriers out of the State altogether or have forced those remaining to be very selective.

Recognizing the chaos, the Legislature in 1993 created the insurer of last resort, the FWCJUA. This is a State of Florida insurance company that does not have the backing of the general revenues of the state. Unfortunately, their application process is complex and the documentation required is extensive. However, when all of the data is provided they must issue the policy no matter what adverse conditions exist with the applicant.
